This evidence and these allegations relate to the applicant&#8217;s challenges to previous statutes,<span style=\"font-size:13px;line-height:11px;\"><sup>96<\/sup><\/span> and to various documents and briefs submitted by the Attorney General of Canada to the Supreme Court of Canada in the Reference leading to the Advisory Opinion of 1998, to copies of <i>Parti Qu\u00e9b\u00e9cois<\/i> political programs, and a resolution of the National Assembly of October 2013, after the Attorney General of Canada intervened in the judicial file.<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"491\" valign=\"top\" style='width:368.2pt;padding:0 5.4pt;'>\n<p class=\"MsoNormal\"><b>[208]<\/b>&nbsp; <b>Burden of proof, presumption of constitutionality and available remedies<\/b><\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"491\" valign=\"top\" style='width:368.2pt;padding:0 5.4pt;'>\n<p class=\"MsoNormal\"><b>[221]<\/b>&nbsp; In the present case, it must be remembered that the Applicant\u2019s initial motion underwent a purge by which 4 of the 6 original conclusions sought were stricken from the record.<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"491\" valign=\"top\" style='width:368.2pt;padding:0 5.4pt;'>\n<p class=\"MsoNormal\"><b>[223]<\/b>&nbsp; Par contre, lorsque c&#8217;est la conduite d&#8217;un repr\u00e9sentant de l&#8217;\u00c9tat qui est attaqu\u00e9e, c&#8217;est-\u00e0-dire lorsqu&#8217;un fonctionnaire applique une loi par ailleurs constitutionnelle, mais de mani\u00e8re inconstitutionnelle, une telle conduite a pour effet de violer la <i> Charte<\/i> et il faut comprendre que ce n&#8217;est pas la constitutionnalit\u00e9 de la loi qui est en cause.<\/p>\n<\/td>\n<td width=\"491\" valign=\"top\" style='width:368.25pt;padding:0 5.4pt;'>\n<p class=\"MsoNormal\"><b>[227]<\/b>&nbsp; On the other hand, when the conduct of a State official is attacked, i.e., when an official applies an otherwise constitutional law, but in an unconstitutional manner, such conduct has the effect of violating the <i>Charter<\/i> and it must be understood that it is not the constitutionality of the law that is in question.<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"491\" valign=\"top\" style='width:368.2pt;padding:0 5.4pt;'>\n<p class=\"MsoNormal\"><b>[228]<\/b>&nbsp; Le rem\u00e8de disponible ne peut alors viser le texte de la loi sur lequel s&#8217;appuie le fonctionnaire pour commettre son geste inconstitutionnel.&nbsp; En semblable cas, le rem\u00e8de ne trouve pas sa source dans l&#8217;article 52 de la <i>Loi constitutionnelle de 1982<\/i>, mais dans l&#8217;article 24(1) de la <i>Charte<\/i>.<\/p>\n<\/td>\n<td width=\"491\" valign=\"top\" style='width:368.25pt;padding:0 5.4pt;'>\n<p class=\"MsoNormal\"><b>[228]<\/b>&nbsp;
